Political parties: Iraqi court has no right to close any party

Political parties affected by the decision of the Iraqi Supreme Judicial Council have asserted that the ruling against them is politically motivated. They explained that the court has no authority to issue an order to close any political party without justification and called on Iraqi political forces to take a serious stance against the decision.

The Judicial Electoral Commission of the Iraqi Supreme Judicial Council announced the closure of three political parties in Iraq and S. Kurdistan: the Movement for the Freedom of Kurdistan Community (Freedom Movement), the Yazidi Freedom and Democracy Party (PADÊ), and the Democratic Struggle Front.

The Autonomous Administration of Şengal condemned the Iraqi Supreme Court's decision to dissolve the Yazidi Freedom and Democracy Party, asserting that the decision was made under orders from the Turkish state and called on the Iraqi government to immediately reverse it.

The Autonomous Administration of Şengal stated: "The Iraqi Supreme Judicial Council issued a decision to dissolve parties representing the Kurdish and Yazidi people in Iraq, including the Movement for the Freedom of Kurdistan Community (Freedom Party), the Yazidi Freedom and Democracy Party, and the Democratic Struggle Front."

It was emphasized: "This decision is one of the outcomes of Turkish President Recep Tayyip Erdogan's visit and his signing of 26 agreements with the Iraqi government. It falls within the terms of these agreements concerning the Yazidi community, indicating that it is a decision of the Turkish state."

The Autonomous Administration pointed out that the issuance of the decision on the tenth anniversary of the Yazidi genocide reflects a continuation of the genocide against them and shows a lack of respect for the Yazidi people and their sacrifices.

They demanded that the Iraqi state cease cooperation with the Turkish state and noted that such unethical agreements will bring calamities and division to Iraq. They also called on the Yazidi community and all parties and institutions to rally around the Yazidi Freedom and Democracy Party, asserting that the decision targets the Yazidi community as a whole, not just the Yazidi Freedom and Democracy Party.

Hussein Haji, co-chair of the Yazidi Freedom and Democracy Party, stated that the court has no authority to issue an order to close any political party without reason. He said, "The legal avenues are still open to us, and we have the right to appeal the federal court's decision regarding our party. We will exercise our rights to the fullest and protest." This statement was made to Roj News.

Hussein Haji also remarked, "The decision to close the Yazidi Freedom and Democracy Party, like many other conspiracies, is a plot targeting Şengal. Our party was officially established in 2017. All of our members are officially recognized and are from the Yazidi and Arab communities of Şengal. The Yazidi Freedom and Democracy Party operates in Şengal and has led efforts in the region, carrying out significant activities for Yazidi unity. Everyone has the right to participate in the Yazidi Freedom and Democracy Party. The party formed a coalition in the elections. The decision to dissolve the party is a political one, aimed at targeting its activities."

Hussein Haji called on political parties in Şengal and Iraq to take a stand against the decision, stating, "The decision taken today against our party will be applied to another party in Iraq tomorrow. With this decision, they are trying to target the priorities and activities in Şengal. All legal avenues are open to us, and we can demand our rights. We do not accept the decision. According to state laws, no political party can be dissolved without cause. We have the right to object. Other parties should also show their stance, as the Yazidi Freedom and Democracy Party is an officially recognized party.”

Call for Iraqi political forces to take a serious stance

Tara Hussein, co-chair of the Kurdistan Freedom Movement, expressed her complete rejection of the Iraqi Supreme Judicial Council's decision to dissolve three Kurdish parties, calling it a purely political decision based on incorrect information, external interference, and betrayal.

In a press conference, Tara Hussein stated that the movement was not notified or warned before the decision was issued, and considers this decision part of a political campaign targeting them. She emphasized that the movement has not committed any illegal acts and its members have not been involved in any legal violations.

Tara Hussein said, "We reject these accusations in their entirety and consider this decision illegal and based on significant political misrepresentation. We have compelling evidence of our legitimacy, and no one has presented any evidence against us."

She called on all political parties in Iraq and the Kurdistan Region to take a serious stance against this dangerous decision that threatens political freedom. She confirmed that the decision is purely political, based on false information, and aims to destabilize and create division among the components of the Iraqi people.

Targeting our party is a purely political decision

The Yazidi Freedom and Democracy Party (PADÊ) has called on the Iraqi government to reverse the Federal Court's decision to dissolve the party. The party stated in a press release that it was established in accordance with applicable laws and has participated in three electoral cycles without recording any violations.

The party explained that it was founded under Decree No. 40 issued by the Political Parties Directorate in 2017, in accordance with the Political Parties Law. It has participated in three electoral cycles, operating within the law throughout this period with no negative points recorded against its policies. All members of the party's political bureau were elected by the people in the presence of a party conference monitoring committee, and the party includes both Yazidi and Arab components.

The party said, "We confirm that the targeting of our party is a purely political decision. While we respect the decision of the Iraqi Supreme Judicial Council, there may be incorrect information about our party and its supporters."

The Yazidi Freedom and Democracy Party stated that it will appeal the decision in the relevant courts and affirmed: "We deny any connection to foreign entities.”
