Tomorrow, Turkey to discuss mechanisms for implementing “framework law”

The Evaluation and Monitoring Committee in Turkey is set to convene for the first time tomorrow, on Monday, to discuss mechanisms for implementing the “Law on Strengthening National Unity and Social Integration,” known as the “Framework Law,” which is linked to the “Peace and Democratic Society Call” launched by leader Abdullah Ocalan to resolve the Kurdish issue.

The meeting is expected to address the formation of specialized committees to oversee the laying down of arms by the party’s military forces, judicial matters, reintegration, and the registration of individuals eligible to benefit from the law.

The meeting comes as the Turkish authorities seek to establish practical mechanisms for implementing the provisions approved by parliament under what is known as the “Framework Law,” particularly those related to the disarmament process and the legal and social measures associated with it.

The meeting will be chaired by Turkish Vice President Cevdet Yılmaz, with the participation of the ministers of Justice, Foreign Affairs, Interior, and National Defense, as well as the Secretary-General of the Presidency, the head of the Turkish Intelligence Organization, and the Secretary-General of the Turkish National Security Council.

Committees to oversee the disarmament process

One of the key issues on the meeting’s agenda is the formation of subcommittees tasked with overseeing the various stages of the process.

The first of these committees is expected to focus on the disarmament process and mechanisms for verifying it, in addition to monitoring developments on the ground.

The committee will work to establish detailed mechanisms for collecting weapons, including determining the locations where they will be collected, the timing of the process, and the procedures to be followed to ensure its implementation and verification.

Judicial process for returnees

In parallel, a committee dedicated to judicial matters is expected to be formed, comprising officials from the Ministry of Justice, judges, and prosecutors. Its purpose will be to review and classify the judicial files of individuals who will return to Turkey, based on the status of each case before the courts.

Under the proposed mechanism, the subcommittee will not have the final authority to decide whether sentences should be enforced or postponed. That authority will remain with the enforcement judge, in accordance with legal procedures.

The law provides for the postponement of investigations, court proceedings, and certain sentence-enforcement procedures against party members who apply to benefit from the mechanisms established by the law, for a period of up to six months, after fulfilling the conditions stipulated therein..

What is the “Framework Law”?

The “Law on Strengthening National Unity and Social Integration” serves as the legal framework underpinning the new measures related to the “Peace and Democratic Society Call” process in Turkey.

The law links the implementation of several of its provisions to an announcement by the Turkish National Security Council (MGK) of the results of the verification process concerning the party’s handover of its weapons in the areas where it operates.

The Turkish parliament approved the law during a plenary session by a vote of 467 in favor, establishing the legal basis for the steps for which implementation mechanisms are now being developed.

Tomorrow’s meeting of the Evaluation and Monitoring Committee is expected to determine the structure and mandates of the subcommittees, as well as mechanisms for overseeing the disarmament process and the judicial and social measures associated with it. This makes the meeting a key step in moving from the legal framework approved by parliament to practical implementation mechanisms on the ground.
