Law expert: transfer of US embassy to Jerusalem is illegal

International law professor Dr. Abdul Karim Shibeir said that all UN resolutions issued by the Security Council prove that the American steps to transfer the embassy to Jerusalem are "illegal".

He described the transfer ceremony of the embassy, ​​which was trying to implement the decision of US President Donald Trump, on the ground forcibly away from the diplomatic protocols.

Dr. Shibeir said that Palestinian President Mahmoud Abbas sent a clear message that "America has become part of the Palestinian-Israeli conflict and has become a rival to the Palestinians." This prompted Abbas to demand UN auspices for negotiations between the two sides.

He said that Abbas did not deny the continuation of negotiations with the Israeli side, but he did not want to be the only US "sponsor of the file of negotiations and the process of a solution in the Middle East," and added, "The president called on the international community to take responsibility from the moral and humanitarian aspect of the Palestinian issue."

Dr. Shibeir pointed out that it is possible to restrict America within the Security Council by transferring the file from the Security Council to the General Assembly, after obtaining two-thirds of the votes in the Security Council, as well as in the General Assembly with two-thirds of the members voting in favor of the resolution, it becomes binding.

Dr. Shibeir believes that the elimination of the American veto on the Palestinian issue could be through the submission of a member of the Security Council a draft resolution, and not to involve the United States in the vote and considered a party to the existing dispute, and thus prevent them from voting and objection.

Hawar news agency (ANHA) interviewed Dr. Shibeir said that the Palestinian leadership has agreed to transfer the file "settlement" to the International Criminal Court, noting that "these settlements are a war crime in accordance with the law and international agreements.”

Dr. Shibeir talked about the targeting of Israeli troops to the Palestinians on the anniversary of al-Nakba, and stressed that "The use of poisonous gas and explosive bullets is a war crime and constitutes a violation of the Fourth Geneva Convention, which guarantees the protection of civilians, adding that this places Israel under legal responsibility".
