Jurist: Turkish presence itself is an occupation not recognized by international legal rules

A member of the Arab-European Center for International Law, Dr. Mukhtar Ghobashi, said, “Turkey insists on targeting the Autonomous Administration of North and East Syria, because it does not want this experiment to succeed, and to prove that, based on the gains, it has been able to achieve a lot in the past ten years, and this is an issue.” Turkey, which is disturbed by the repetition of the experience of the Kurdistan region in parallel to it, or more literally in NE, Syria, is not happy, because the Kurdish file is disturbing to it, and it does not want this “contagion” to spread from one place to another, so targeting the Autonomous Administration, weakening it, and putting pressure on it militarily, enters into In a form of bargaining.

Dr. Ghobashi added to ANHA's agency, “The results of this targeting will not be in favor of Turkey, and there are regional and international parties that intervened with Turkey, because the Damascus government set a condition for normalization with Turkey, which is the complete withdrawal of its forces from Syrian territory, including NE, Syria, and Russia and Iran tried to... Through mediation, they provided security guarantees to the Turkish side that the common border between Syria and Turkey would not be tense, and to reassure Turkey and Syria so that the relationship between the two sides returns to normal, but there are several reasons delaying the return, the most important of which is the continued Turkish targeting and securing the tense border and others...”

As for the legal aspect, a member of the Egyptian Society of International Law confirms that “targeting infrastructure from a legal perspective is a form of infringement, and it is a violation of the rules of international laws, because the Turkish presence itself is an occupation, not approved by the rules of international laws or international legitimacy, and thus the legal issue.” It could be used to put pressure on the Turkish side due to the lack of legal legitimacy for its presence in northern and eastern Syria, or to target it militarily.”

Regarding the international and NATO silence on what is happening in NE, Syria, Dr. Ghobashi explained, “Interests are reconciled, and the weaker party’s rights are in vain, and Turkey is one of the important countries in NATO, and the second most important military force after the United States of America, and the important American Incirlik base.” From which American reconnaissance planes depart, it is an important base for America and NATO, and Washington does not want to lose or put pressure on Ankara, and this is known, although it is disturbed, due to the difference in positions on both sides, especially since Turkey is going in the Russian and Chinese direction, and is neutral in the American-Russian conflict. "

A member of the Egyptian Society of International Law and the Arab-European Center for International Law, Dr. Mukhtar Ghobashi, concluded his speech by saying: “Whenever the position in the Autonomous Administration is coherent, has a basis, and achieves security, administrative, practical, and judicial success... he succeeds in taking steps towards realizing the dream of the Autonomous Administration by establishing this matter, and the existence of a constitutional and legal basis for it in Syria, and for it to have official approval, and this requires effort at home and abroad, with regional and international parties.”
