Lawyer: Imrali witnesses violations of internal and international agreements

A member of the Syrian Lawyers Initiative to Defend the Leader Abdullah Ocalan explained that the violations committed against the leader are a violation of the Convention on Human and Prisoner Rights, articles of law and the Turkish constitution, calling on lawyers and jurists in Europe to work for justice.

The Turkish state violates all international standards and human rights laws by imposing "disciplinary penalties" on leader Abdullah Ocalan every six months, and preventing him from communicating with the outside world, including Principle 16/1 of the Standard Minimum Rules for the Treatment of Prisoners in the Universal Charter on Human Rights, which stipulates that "every A remand or imprisoned person has the right to inform, and it is the duty of the responsible authority to notify his family members or any other persons of his choice.

And also the International Convention for the Protection of All Persons from Enforced Disappearance in Article /1/, paragraph 1-2 of the first part, as it also states that “no person may be subjected to enforced disappearance.”

A member of the Syrian Lawyers’ Initiative to Defend Leader Abdullah Ocalan, Khaled Omar, saw that there is no legal basis for the “disciplinary penalties” imposed by the Turkish state on the leader, and said: “These penalties are imposed on a prisoner who violates prison laws within the public prison, but the leader Abdullah Ocalan is detained in solitary confinement, and thus he does not violate any of the prison laws.

Khaled Omar explained that these penalties come with the aim of tightening the strict isolation, preventing any meeting between the leader and his lawyer or his family, and defining the leader Abdullah Ocalan as an undisciplined person and a lawbreaker in front of public opinion, as well as depriving the leader of the "right to hope."

He continued, "By applying the right to hope to the prisoner, it is stipulated that the prisoner's file does not include any disciplinary punishment, so the Turkish state imposes these penalties on the leader as arguments for depriving him of the right to hope."

Inform his lawyer of the new decisions

Referring to the Turkish state's breaches of its internal laws, lawyer Khaled Omar affirmed: "According to the Turkish laws themselves, it is not permissible to prevent meetings between a prisoner and his lawyer even under the imposition of "disciplinary penalties", so he imposed these penalties against the leader Ocalan and also prevented him from meeting with his lawyer and cut him off from the outside world has no legal legitimacy."

The Turkish state also violates Article /26/ of Article Eight of its constitution regarding "freedom of expression and dissemination of thought by completely cutting off the leader from the outside world, as this article affirms" the right to express ideas and opinions and publish them verbally, in writing, pictures, or through any means. Another right is for everyone, individually and collectively. This right includes freedom to receive and impart information and ideas, without interference from official authorities. The previous ruling does not preclude subjecting broadcasting through radio, television, cinema and other means to a licensing system.

Omar emphasized that the reason for imposing "disciplinary penalties" must be clarified within the same decision, and his lawyer should be informed of this decision because they have the right to object to these decisions within a specific period. Therefore, the Turkish state is violating laws in all its details regarding the file of leader Abdullah Ocalan.

Psychological torture

Indicating that the violations committed by the Turkish state fall under the name of "psychological torture" and a violation of the Convention on Human and Prisoner Rights and the internal laws of the Turkish state.

Regarding the international law's view of these violations, Omar said: "Without a doubt, the Turkish state will not be held accountable for violating its internal laws, but the Committee against Torture (CPT) and the Human Rights Committee of the Council of Europe must hold Turkey accountable for its violations."

The issue of Ocalan is a global issue

A member of the Syrian Lawyers Initiative to Defend the Leader Abdullah Ocalan, Khaled Omar, called on all lawyers and human rights activists in Europe to work for the protection of justice by putting pressure on their governments in order to put pressure on Turkey and achieve the physical freedom of the leader and not just break the isolation.

He added, "The issue of leader Abdullah Ocalan is unparalleled in our current era, as it is the issue of peoples and societies, not just the issue of a person."

Leader Abdullah Ocalan says in the letter he sent to the Presidency of the European Court of Human Rights in Strasbourg - France, at the conclusion of his fifth volume of the (Manifesto of Democratic Civilization) "The special isolation applied to me in Imrali prison and the laws I mentioned, which Turkey will issue under the pretext of harmonizing them with European law, violate the laws In its content, the Commission's failure to conduct a retrial in my favor contradicts your first decision, i.e. the "retrial" decision, and stressed the importance of "your amendment of that decision through the final decision that you will issue in my favour."
