Lawyers of Leader: CPT must urgently visit Imrali

No information was received about Leader Abdullah Ocalan and his comrades in Imrali,  Omer Khairy Konar, Hameli Yildirim, and Weysi Aktaş 30 months ago.

Al-Asr Office submitted a request to the Committee for the Prevention of Torture (CPT) of the Council of Europe regarding the events that took place between April 30, 2023 and June 31, 2023, in which it stated that since March 25, 2021, no information has been received about the leader Abdullah Ocalan and his companions, Hameli Yildirim. Omer Khairy Konar and Weysi Aktaş.

It also mentioned that meeting with lawyers and the family is restricted, and said: “The right to send and receive messages is also hindered, along with the right to seek the assistance of lawyers, defense, or a fair trial, even the applicants are deprived of all their rights protected by the agreements, and their contact with the outside is completely cut off and they are under absolute isolation, “In light of the violation of the laws prohibiting torture, we inform you and express our demands to you.”

Within three months 37 requests were left unanswered

The lawyers indicated that between April 30 and June 31, 2023, and within 3 months, in addition to 25 requests by lawyers, 12 family requests were left unanswered.

The lawyers said that not even a single letter from the applicants reached the detainees, and stated that they did not know the fate of the letters sent to Imrali.

Attempts at disciplinary penalties aim to cover up illegal practices

Al-Asr Law Office announced that the "disciplinary penalties" lasted for three months, and stated that on June 30, 2023, despite the end of the 3-month disciplinary penalty, the applications submitted by the family in June were received and rejected.

The lawyers announced that in order to remove the obstacles before the family meeting on July 10, they applied to the Bursa Criminal Court, and learned that a new "disciplinary punishment" was imposed.

The application stated that the new "disciplinary punishment" was an attempt to cover up the violation of rights.

The lawyers confirmed that all judicial and administrative bans are baseless.

The request states, “It has been clearly proven that the banning of the lawyers’ meeting since July 27, 2011 is a political decision that has nothing to do with international and local law, during the implementation of these decisions, information is not given to lawyers, and lawyers are left outside and this is done in a confidential manner ".

It was announced in the request that "concerns about the life, health and human rights security" of the leader Abdullah Ocalan had reached the highest level, and it was said that the Justice and Development Party government does not abide by the findings and recommendations of the Committee against Torture, and continues the chaos and tries to justify it politically.

Yesterday, Al-Asr Office submitted a request to CPT, which read:

“* Your committee, in addition to disclosing its findings and the last visit report, must urgently visit Imrali Island Prison.

* It must be agreed to visit lawyers immediately and put an end to obstructing court decisions that violate the law.

* The visitation of the family must be carried out to the fullest extent and an end to the impediment represented by disciplinary penalties that violate the law.

*In addition to exercising the visitation right, the applicant can exercise the right to make routine phone calls with his family and relatives.

Obstacles to the right to correspond must be removed.

Ending legal proceedings against the right to receive newspapers, magazines and books.

* The necessary measures should also be taken to eliminate torture, inhumane acts, bad conditions and conditions of solitary confinement, and Article 10/2 of the Convention must be implemented.
