On December 14th, 2015, in response to attacks by the Government of Iraq on its territory by the Turkish Occupation Army, the Permanent Representative of Iraq to the United Nations, Mohammad Ali Al-Hakim, submitted a note to the Security Council, calling on the Council to intervene and prompting Turkey to withdraw its forces unconditionally to the international border between the two internationally recognized countries.

In its memorandum, the Iraqi Government stressed that Turkey should not return to breach of Iraqi sovereignty, considering it a major threat to regional and international peace.

At the meeting of the Security Council, the Government of Iraq considered the Turkish military incursion to be a serious breach of Iraq's sovereignty, the principles of international law relating to good-neighborliness and the non-interference of any State in the internal affairs of the neighboring State, in accordance with Article 2 of the Charter of the United Nations.

This article provides that "all members of the body shall be prohibited in their international relations from the threat or use of force against the territorial integrity or political independence of any State or in any other manner inconsistent with the purposes of the United Nations."

Iraqi efforts

On the need for Turkey to withdraw its forces and not to attack Iraqi territory, Iraq has received the support of the League of Arab States and the Council of Ministers for Foreign Affairs of the Arab States.

In the same effort, in 2016, the entire Iraqi Parliament voted on a resolution condemning the presence of Turkish forces on Iraqi territory as an occupying Power, calling on the Iraqi Government to take action to preserve Iraq's sovereignty and to approach the United Nations, the Security Council and the League of Arab States once again in order to remove Turkish Forces from northern Iraq.

Despite the great support that Iraq received from the Arab States and its determination in the Security Council to move towards the removal of the Turkish Occupation Army from Iraqi territory, the Council did not heed the call of the Iraqi Government and failed to respect the resolutions of the Iraqi Parliament and the League of Arab States to convert the memorandum into a United Nations resolution.

'Turkish and Iranian ambitions

Political analyst and consulting engineer, Nahad Qazi, commented: "Turkey has increased Turkish bases, increased its occupation of the mountains of the Kurdistan region of Iraq, and of Greater Southern Kurdistan, and aspires all its leaders to the dream of restoring Mosul Governorate to Turkey, which means a large part of the Kurdistan region in addition to Kirkuk."

Fighting PKK

On April 23rd, the Turkish Occupation Army renewed its attacks on the legitimate defence zones of Başûr Kurdistan, specifically the areas (Zap, Avaşîn, Metîna), where these attacks continue, following the attacks on Gara last February and before on Haftanin last year.

'Sovereignty of Iraq'

For his part, political analyst Nahad Qazi said that the reduction of Iraq's sovereignty took hold after the Turkish Minister of Defence entered Iraqi territory and the Kurdistan Mountains, inspected Turkish military bases and honored some Turkish officers, without the knowledge of the Kurdistan Regional Government and the Iraqi Government.

He said: "This also opened the way for the Turks to increase their attacks and bomb Kurdish villages adjacent to Mount Kistah, and forced Kurd citizens and Christian villagers to leave their homes, fields and farms vulnerable to Turkish missile fire."

Legal base'

The military intervention of the Turkish Occupying State in Iraqi territory, which still exists, lacks a legal basis in international law, as it took place without Iraq's consent or invitation to Turkish military forces.
