Dozens of human rights defenders discuss ways to sue Turkey for its crimes in Syria

 Today, dozens of human rights defenders discussed ways to sue Turkey in international forums by filing lawsuits with the International Criminal Court, in a move aimed at ending the occupation and ensuring accountability for the perpetrators of war crimes against the residents of northeast Syria.

 Today, the Serekaniye Displaced Persons Committee organized a legal dialogue seminar for human rights defenders and lawyers of Serekaniye and its countryside, to shed light on the crimes of the Turkish occupation and its mercenaries in the occupied areas in northern and eastern Syria, including the Serekaniye area, and to focus on the role of jurists and lawyers.

 The seminar was run by dozens of lawyers, judges and jurists, in addition to dozens of displaced persons living in the camp.

 The seminar was directed by Mahmoud Jamil, the spokesman for the Serekaniye Displacement Committee, a member of the committee, Jiwan Eso, and a judge in the Court of Justice in the city of al-Hasakah, Kadeer Naama.

 The seminar began with a minute of silence in honor of the martyrs, followed by the speech of the judge at the Court of Justice in the city of Al-Hasakah. He focused on the continuation of the Turkish occupation forces and its mercenaries to commit crimes against humanity two years ago, and their violation of all international covenants, international law and human rights.

 Noting, "It violates all international laws and charters for the sovereignty of states and respect for their borders. The Turkish occupation and its mercenaries have not stopped demographic change since the first day of the occupation of the two areas. It has also recently brought the families of its mercenaries from different Arab and foreign nationalities and settled them in the homes of the indigenous people." 

 At the end of her speech, she demanded, on behalf of the lawyers and jurists, the international community, the Global Coalition and international human rights and humanitarian organizations, to carry out their moral and humanitarian duties before the law , put pressure on the Turkish occupation to stop its attacks against all citizens in Serêkaniyê, Girê Spî and Afrin, and expel them from the areas it occupied.

Lawyers: The Turkish occupation of the territories constitutes two crimes against public law

 The seminar included an extensive discussions on the legal framework, as they pointed out that the occupation of the Turkish occupation state and its mercenaries to the areas of northern and eastern Syria are two crimes, the first of which is the occupation of the neighboring countries, and the second is its continuous attacks on them.

 Lawyers pointed out that these two crimes are in violation of public and humanitarian law, all international covenants and covenants.

 The lawyers noted, "The international silence is nothing but a legitimization of the occupation."

 The seminar concluded with a general statement by lawyers, judges and jurists to the media.

 It stated:

 Today, Tuesday, 12/10/2021, the Displaced Persons Committee of Serêkaniyê / Ras al-Ain held a “legal” seminar with the participation of displaced lawyers and jurists, under the slogan “Safe return without occupation” in the context of its campaign condemning the Turkish aggression.

 Where the discussions centered on the current situation as a result of the occupation and its effects, and the adoption of the policy of forced displacement and demographic change through the recruitment of foreign settlers and families of terrorist factions, including the terrorists of ISIS and al-Qaeda, and settling them after the city was emptied of its residents, as well as the  systematic violations against the few remained civilians.  Theft and looting of the region's resources, as well as the destruction of infrastructure, premeditated murder, torture, kidnapping, imposing royalties, and forcibly seizing homes, commercial and industrial stores by force of arms.

 As well as discussing the role of jurists and lawyers in light of these gross violations and crimes that are still ongoing, as well as how to deal with these cases legally in accordance with the principles of human rights and international charters and covenants that protect the lives and rights of civilians, and work to communicate with human rights and legal organizations to inform them of the miserable reality  Pension in camps and shelter centers that lack the most basic necessities of life, in addition to the legal and humanitarian condition of the occupied area.

 As a result of all the discussions mentioned, the meeting concluded the following:

 First: It was affirmed that our cause expresses inalienable rights, foremost of which is ending the occupation and the right of return, as well as conveying the suffering and tragedies of the displaced and the miserable situation to world public opinion and international forums by documenting according to the available evidence.

 Second: Monitoring and documenting violations in coordination with the relevant local and external authorities, as well as exposing crimes committed by the Turkish army and armed factions, following up on the legal status of detainees inside the prisons of armed factions and the Turkish state, and putting pressure on human rights and international bodies to review their conditions, and working to release them through legitimate legal means.

 Third: Notifying the international bodies, international human rights organizations and the guarantor countries of what is happening on the ground based on the reports received confirming that the terrorist organizations (ISIS - Al-Qaeda) have begun to organize themselves again in the occupied areas, and receive training with funding from the Turkish state, which poses a threat to the efforts to replace  Peace in Syria.

 Third: Communicating with jurists and lawyers from the city’s people abroad to start the necessary preliminary procedures in order to submit formal complaints to international bodies, including the International Criminal Court in the Hague as a permanent international institution so that the perpetrators do not go unpunished, and to appoint international lawyers to adopt the case.

 Fourth: Prepare in the next stage to start discussing the mechanism of filing criminal cases before the International Criminal Court to try war criminals and all those who had a role and are still involved in committing crimes among the leaders of the Turkish state and its military factions (politicians and military), and convict them with evidence and official reports documented before the national and foreign courts to duly refer the perpetrators to justice.

 Fifth: Forming (legal) committees from internally and externally displaced persons to follow up all legal files in accordance with the laws in force in the countries in which these committees are located, in coordination with lawyers and jurists in Syria and abroad, to bring the Turkish state into compliance with the decisions of international legitimacy.

 Sixth: Working to establish special courts in order to try the perpetrators.

 Seventh: Working to hold a legal dialogue session at the level of the Al-Jazira region, with the participation of jurists, lawyers and judges, to discuss the case.

 Eighth: Continuing to hold a series of "legal" seminars and dialogue sessions at home and abroad to shed light on all violations and follow up on developments and developments on the Syrian arena to support and strengthen our legitimate cause and to strengthen legal action.

 Ninth: Preparing for a wide legal symposium at the level of north and east Syria, to discuss the issue.
