The file of the ISIS mercenaries is one of the most impossible ones in the world, as thousands of mercenaries are detained in the prisons of the Autonomous Administration.

Despite its seriousness, the international community evades its responsibilities towards the file.

About 19,000 ISIS mercenaries are held in the Autonomous Administration prisons in NE Syria, including 12,000 Syrian ISIS, 5,000 Iraqi ISIS, and 2,000 foreign ISIS militants from 55 foreign countries.

Currently, ISIS mercenaries of Syrian origin are appearing before the People's Defense Court in northern and eastern Syria.

In this vein, member of the Council of the Social Justice in NE Syria, Khaled Ali, said that since the early 2020, 900 Syrian mercenaries have appeared before the People's Defense Court.

He explained that the trial of Syrian ISIS mercenaries is going on. As for foreign mercenaries, none of them has appeared before the court so far.

No international party has provided any assistance to the People's Defense Court regarding the trial of ISIS mercenaries so far, despite the CSJ held meetings with several powers and countries within the Global Coalition against ISIS mercenaries, including Britain, France, and a German parliamentary delegation.

"No support was provided to the courts, except for some logistical matters," Ali asserts.

The international community does not show cooperation

Ali stated that they technical challenges they face in terms of judges and investigators, the role of the judiciary and prisons, lack of sworn interpreter, in addition to the insecurity amid the ongoing Turkish attacks on the regions of NE Syria, and absence of the cooperation of the international community in the file of ISIS detainees.

Ali drew attention to the fact of lack ISIS personal records, he said: “Therefore we called for establishing a committee within the Global Coalition to solve this dilemma since the beginning of ISIS last stronghold, Al-Baghouz. Our request is not being answered till now. "

Syrian mercenaries are being tried under the laws of the Autonomous Administration, especially Decree No. 20 in the Al-Jazira region in 2014, and the Syrian law is referred to in the absence of a text punishing the crime within the Autonomous Administration laws. There is no death sentence in the Autonomous Administration laws, and minors are not put before the trial.

Ali stressed on the need for establishing an international court for persecuting the ISIS

The AANES and Peoples Defense Court called several times on the international community for establishing a court for persecuting the foreign ISIS in the prisons of the AANES that counts to up 1000 mercenaries from 55 different countries, despite the promises of the many countries but they were not translated into reality. Placing an additional strain on the AANES institutions.
