Lawyer: PDK's refusal to hand over martyrs' bodies is a crime and betrayal

Since October 5 the sit-in tent at the Semalka border crossing is still going on amid people' calls, the national bodies, the families of the martyrs and the mothers of peace to hand over bodies of the guerrilla fighters who were martyred in the ambush set by the party's gunmen in the Khalifan area on the 28th of last August, including the two martyrs, Tolhildan Raman and Serdem Judi, from Rojava.

Member of the Lawyers Union at Al-Jazeera Region, Muhammad Amin Al-Nuaimi, referred to the Khalifan ambush, by saying“ it has fallen under the influence of Turkish fascism that hostile the indigenous peoples, especially the Kurdish people.

Turkish fascism since the era of the Ottoman Empire has been committing massacres against peoples".

He continued, "The families of the so-called "Leshker Roj" headed towards the sit-in tent, confirming that they had sent their sons to be protectors of Kurdistan, not mercenaries in the hands of Turkish fascism through PDK.

He confirmed that, "Whoever falls under the control and influence of the Kurdish people enemy is a traitor, and cannot hide and erase the facts, he quoted a Kurdish proverb: "The arrow does not remain in the quiver."

Al-Nuaimi noted, "from a legal perspective we as lawyers consider what happened as an international crime . The Murder is a crime, and failure to hand over the bodies is a crime too. The perpetrator, no matter how criminal his genetic inheritance is, does not refuse to deliver the victim's body to his relatives

Al-Nuaimi added, "The Lawyers' Union is closely following the issue through international human rights organizations, which consider these crimes violations of the principles and laws of the United Nations, Geneva laws in 1947 and the Hague War relevant ones in 1907."

Al-Nuaimi pointed out that "According to international law, civilians and fighters who defend of their people's freedom, it isn't acceptable to keep of their bodies, Therefore, the Kurdistan Democratic Party, with its actions and being under the control of Turkish fascism, is committing a major crime against the Kurdish people."

Al-Nuaimi said there are two reasons that prevent PDK from delivering the bodies, the first reason is to conceal its crime if it legally prosecuted, the second one is the Turkish fascism which is trying to ignite strife among the Kurds and stymie calls that launched to unite the Kurdish ranks in NES.
