Legal Adviser: In Turkey, judge is culprit, so how can he put law to deter himself?

"Jarkush" area in the state of Batman in Northern Kurdistan witnessed a sexual assault against a 15-year-old girl by officials and members of the Turkish government. The incident came after the pregnancy of the girl who was found to have been raped in the hospital after she went while complaining of abdominal pain.

After the results of the investigations into the crime were released, the women on social networks launched a hashtag campaign entitled GercüşteNeOluyor #? (# What is going on in Jarkush?) to demand the disclosure of the circumstances of the crime and the accountability of the perpetrators, and executives, parliamentarians from the HDP participated in the campaign.

According to the complaint, two men called F.A. and M.W. were arrested. According to a report published by (Jin News) agency on December 5^th, 27 people were involved in the rape, including the police, the sergeant and the village guards.

The case sparked widespread public and human rights condemnation inside and outside Turkey by women, in light of the increasing reports on violence against women, and in this regard, the Legal Advisor at the Sara Organization for Combating Violence against Women in Qamishlo district, Nada Hussein Malaki, spoke to our agency, condemning the crime in turn.

She said: "Women's rights are retreating backward during Erdogan's era, where violations of women's rights continue without any punishment. Here is a new heinous crime that is added to the series of repeated crimes against them."

Nada added: "Violence against women has become a dark part of daily life in Turkey, as women are subject to daily attacks, abuse, rape, kidnapping, arrests and killings, especially Kurdish women."

Nada noted that most of the crimes committed in Turkey are against the Kurdish people, especially Kurdish women because they realize that women are the beacon of the family, so they strike that guiding light to put pressure on the Kurdish people via women, so that they do not demand their legitimate and national rights.

Since the beginning of the Turkish occupation of Afrin in 2018, and according to a report issued by the Human Rights Organization in Afrin, more than 1,000 kidnappings and disappearances of women, and 290 cases of arbitrary detention of women and children have been documented.

Nada indicated that the practices of the Turkish state are not confined to the Turkish interior only, but rather go beyond the areas it occupies (Afrin, Serêkaniyê and Girê Spî), as it shows the extent of its aggression and weakness.

She explained: "There are laws in Turkey, but without implementation, and the laws that were drawn up do not protect women, rather for political purposes related to the political person who receives the government, represented by Erdogan's personality."

Nada Hussein Malaki concluded her speech with the question, "In Turkey, the judge is the culprit, so how can he put the law in place to deter himself from this crime?"
