Avin Juma: European Court of Human Rights does not abide by its laws

The co-chair of the human rights organization in al-Jazeera region, Avin Juma, said the decisions of the European Human Rights Court about the Kurdish People's Leader Abdullah Ocalan contradict the laws of the court. She noted that the court did not follow Ocalan's situation in Imrali prison.

The European Court of Human Rights rejected a complaint filed by the lawyers of the Kurdish People's Leader Abdullah Ocalan for allegedly ill-treatment inside his prison in Imrali.

To talk about the subject, the Hawar news agency met with the co-chair of the human rights organization in al-Jazeera region, Avin Juma, who confirmed that the decision of the court violates the principles of human rights, and that the decision is a political decision.

'Court’s decision contrary to laws and ethics'

"Since September 11, 2016, the Turkish state has prevented the relatives and lawyers, as well as members of the Imrali Body, from visiting Ocalan, and all information about it has been severed since that date, since then, the leader Ocalan has been in strict isolation, and we do not know about his state anything."

She said that the European Court rejected the case of Ocalan where he had been tortured in Imrali prison, saying that the decision is contrary to laws and ethics "This decision is contrary to the norms and ethics of the European Court of Human Rights, although this institution is one the keen advocates for human rights, but unfortunately, in regard to the issue of the Kurdish leader Abdullah Ocalan, it violates humanitarian laws.

'In Turkey, human rights are violated

"Unfortunately, the countries of the world do not regard the isolation of Ocalan as a political issue, the dominant countries ignore human rights for their own interests." Democracy in Turkey is mere rhetoric, not applied on the ground. The number of politicians, intellectuals and journalists detained in Turkey, indicating the lack of democracy, no one can express his opinion freely, there have been many reports against Turkey in these aspects.

Juma also referred to the report of the European Committee against Torture issued on 28-29 April on Imrali, which was banned by the Turkish authorities two years later. "The Committee against Torture, as well as many other organizations were seeking to visit Ocalan, but the Turkish authorities banned visits, the Turkish state did not allow the Committee against Torture and other organizations to see the situation of Ocalan."

'Isolation itself is sufficient evidence'

Avin Juma said that the European Court of Human Rights rejected the case of Ocalan tortured in Imrali prison, and wondered; on what basis the court took this decision, was it based on the Turkish reports? "The European Court of Human Rights is asking for evidence that Ocalan was tortured, and we are saying, how can we bring evidence while the state prevents visits and meetings with Ocalan? As the strict isolation on Ocalan is in itself the biggest evidence, this matter confirms the great contradiction in the decision of the European Court. "

'The European Court of Human Rights has to assume its responsibilities'

"In 2010, the court rejected Ocalan's case of torture, and so far the Turkish state continues to impose strict isolation on Ocalan, but unfortunately the European Court did not take this into account, indicating that the European Court of Human Rights must assume its responsibilities and monitor the state of isolation imposed on Ocalan."

'The decision of the European Court supports the Turkish state'

Avin also said that the international institutions and powers have been silent about the brutality of the Turkish state and are making unjust decisions in this regard. "Anti-human rights resolutions support and encourage Turkey, leading to the rise of dictatorship and the decline of democracy in Turkey.

Avin appealed to all international institutions and the Committee against Torture to stand against the decision of the European Court of Human Rights.
