In light of the ongoing political and security challenges facing Syria, calls are renewed for the necessity of starting to draft a new constitution that provides a comprehensive legal framework to regulate political life and address the existing institutional vacuum, as it is a fundamental step toward achieving stability and rebuilding trust among the components of Syrian society.

In this context, lawyer Masoud Khalaf al-Mulla confirmed that starting preparations for drafting a new constitution for Syria represents a necessary step at this stage, as it lays the legal and political foundation for building a stable state after years of war and conflict.

He added that the constitution helps organize the form of governance, guaranties citizens' rights, and prevents the return of tyranny and chaos, in addition to giving Syrians hope for a future based on justice and participation.

Lawyer Masoud Khalaf al-Mulla saw that the constitution is a fundamental step toward building a state of citizenship and law, as it defines the rights and duties of individuals, regulates the work of state institutions, and prevents the abuse of power. It also ensures equality among all citizens before the law and establishes a relationship based on justice and trust between the people and the state.

Al-Mulla pointed out the key foundations that any democratic and pluralistic constitution for the future of Syria should be based on, which include respecting human rights and public freedoms, equality among all citizens without discrimination, the separation of powers and the independence of the judiciary, in addition to the peaceful transfer of power through free and fair elections, ensuring freedom of opinion and expression, recognizing the national, religious, and cultural diversity in Syria, and reinforcing the principles of citizenship and the rule of law as essential pillars for building a stable and just state.

The lawyer al-Mulla confirmed that delaying the start of the process of drafting a new constitution entails multiple risks, the most prominent of which are the continuation of political instability, the increasing divisions among Syrians, and the persistence of legal and institutional vacuums. He added that this delay could also lead to a decline in trust in political solutions and prolong the duration of crises and conflicts.

He pointed out that national consensus on the constitution could serve as a fundamental entry point for achieving stability and peace, as a constitution that is accepted by various components of society enhances national unity and reduces causes of conflict. It also helps in building a political system in which everyone participates fairly, forming a foundation for building a stable state based on partnership and justice.

He considered that the constitution is capable of contributing to rebuilding trust among Syrians after years of war, by ensuring rights and freedoms for all, establishing principles of justice and equality, and preventing forms of discrimination and exclusion. Additionally, the participation of various segments of society in drafting the constitution can enhance the sense of partnership and belonging, paving the way for national reconciliation and strengthening stability in the country.

He pointed out that to ensure that the process of writing the constitution is not merely formal or subject to narrow political interests, it must be characterized by transparency and inclusiveness, and representatives from all segments of society should participate in it. It is also necessary to ensure freedom of discussion, the independence of the constitutional committee, and the involvement of legal experts, in addition to presenting the draft constitution for public discussion and a general referendum, to ensure the adoption of a document that reflects the will of all Syrians.
