Lawyers submit request to CPT to end isolation on leader Ocalan

 Asrin legal office submitted a request to the European Committee Against Torture (CPT), because it did not have information about Ocalan and the other detainees, Hamili Yildirim, Omer Khairy Konar and Fauzi Aktaş, who live in harsh conditions and conditions of isolation in Imrali Prison, where they were not  information about the leader and his companions since March 2021.

 In its request, the office stated that the continued isolation is to isolate him from the world, and focused on the systematic violation of anti-torture in Imrali.  It provided information to the European Committee against Torture about the events that took place between April and August 2022.

61 requests were rejected in 5 months

 In its request, the office confirmed that 40 requests to meet with lawyers and 21 requests to meet with families were submitted to the Public Prosecution Office in Bursa and the Imrali Prison Directorate between April 1 and August 31, 2022, but all requests were blocked.

 He stated that a request was submitted by 775 lawyers on June 10, 2022 to the Public Prosecution Office in Bursa and the Imrali Prison Directorate, to meet their clients immediately, including the head of the Bar Association, however, the request was not answered and remained unanswered.

 The request of Asrin Legal Office also drew attention to the obstruction of meetings on holidays. It also said that the result of messages sent from clients between March and August is not yet known.

 The request also stated information about the ban on meeting lawyers and the new disciplinary penalties, and that despite placing a ban on lawyers every six months, which began on November 12, 2021 and ended on April 22, 2022, the request was submitted immediately and was rejected and remained without reply. It also stated that on April 13, 2022, the Second Execution Court in Bursa issued a new penalty for meeting lawyers before the six-month ban on them expired, but after submitting the application to the court, the lawyers learned about this.

Despite the end of the disciplinary penalties, the request was refused

 It was known in the meeting request that, despite the end of the disciplinary penalties of the Imrali Disciplinary Authority, which were set on February 3, 2022 and ended in June, the requests were rejected in the Public Prosecution Office. They submitted a request to the First Criminal Court in Bursa in order to testify, as well.  The Criminal Court rejected this request, and it was indicated in the request that the reason for this refusal is on the pretext that the disciplinary penalty is still continuing. Later, it stated that the disciplinary penalty ended on May 22, 2022, and it was also published that the Disciplinary Authority in Imrali learned that a new ban had been imposed on the meeting.  The family has been with the family for 3 months, since May 31, 2022, and they also mentioned in the application that their clients have been denied legal assistance and legal protection, and in this case there is a charge.

 In its request, the office noted that Ocalan and the other prisoners were prevented from communicating with the outside world and deprived of all kinds of legal protection, and insisted that the European Committee against Torture (CPT) go immediately to Imrali, and that the committee should know very well that if they did not receive news  , they will open the way to irreversible damage and end this situation immediately.

 The demands of the meeting request are:

* The Commission shall immediately schedule a visit to Imrali Island.

 * Lawyers must go to a meeting immediately and legally end the ban and penalties.

 * Families and clients must immediately go to meet the prisoners and end all punishments before meeting the families.

 * The right to meet and the right to speak on the telephone must be secured in a routine manner.

 * All obstacles to letters and faxes must be eliminated.

 * It is necessary to end the ban on newspapers, magazines and books and to end all kinds of concepts against the law.

 * All conditions of torture, inhuman treatment and ill-treatment must be ended, isolation from the outside world must be ended, and the measures stipulated in Article 10/2 must be implemented immediately, and the convention should enter into force.
