​​​​​​​Arab and Kurdish jurists: Hope decision must be implemented to Ocalan

Jurists in the city of Raqqa confirmed that the isolation imposed on the leader Ocalan is a crime against humanity, calling on the actors to put pressure on Turkey to amend the provisions of the law related to the arrest of the leader Ocalan and grant him physical freedom and implement the right of hope decision.

More than 23 years ago, the Turkish authorities arrested the leader, Ocalan, and sentenced him to life imprisonment, imposed severe isolation on him and deprived him of his most basic rights as a detainee, amid the shameful silence of human rights organizations and human rights organizations that did not work according to their principles towards the cause of leader Ocalan.

The person sentenced to life imprisonment has the right to leave prison, in accordance with international laws and resolutions represented by the right to hope, meaning that the detainee is released from prison after serving a life sentence. However, the Turkish authorities did not implement this decision against the leader Ocalan and did not demand that international and human rights organizations apply it, which proves that the existence of contradictions in international laws and resolutions.


 

In this regard, the head of the Bar Association in North and East Syria, lawyer, Meshlab al-Turkan, said, "In all international laws and the Turkish state's law regarding detainees, an arrest warrant must be issued against the detainee by the Turkish court or any court in any country."

Al-Turkan added, "The procedures for arresting the leader Ocalan were not legal, and there was no legal procedure to arrest him from the legal aspect and international laws and all laws related to human rights and in force, and after the death sentence was issued against the leader Ocalan and after its legal procedures, the Turkish state retracted this decision and replaced it." life sentence.”

He explained, "The life imprisonment should be for a limited period, and this is what is stipulated by international laws or the so-called right of hope for the detainee after serving 20 to 25 years in prison."

And he indicated, "The issuance of any life sentence does not mean life. Rather, according to the laws in European countries, the period does not exceed 20 or 25 years, and even in the Syrian state law, life imprisonment does not exceed twenty years."

Meshlab al-Turkan, on behalf of jurists and activists in North and East Syria, called on "all actors to pressure the Turkish state to amend the legal texts related to imposing the isolation imposed on leader Ocalan through any institution or organization that sponsors human rights in this field."

In his turn, member of the Kobani Lawyers Union, Mustafa Muslim, said, "With regard to the isolation imposed on the leader Ocalan, it is not a new isolation, but coincided and began since the date of his arrest and subjecting him to various types of physical and psychological torture."

He stressed, "The trial of leader Ocalan was a formal court, similar to the trials we see in films."

He explained, "The laws sponsoring this trial are Turkish laws that have nothing to do with lived reality, but are politicized to serve the Turkish state."

Mustafa Muslim pointed out, "At the same time, the European Union court cannot be relied upon, as it is locked into the political decision that is being asked of it."
