Samir Moubayed rejects her participation in constitutionalism because of catastrophic consequences

The Constitutional Committee continues to fail despite holding eight sessions. Dr. Samira Moubayed, who suspended her participation in these sessions, warned that this committee will result in catastrophic results, most notably the establishment similar ideologically, nationally or sectarian areas in contrast to the structure of Syrian society. The parties of the committee are unable to build a modern Syrian constitution that establishes the citizenship state.

And the so-called Constitutional Committee resumed its eighth round, last Tuesday, in Geneva, without achieving any significant breakthrough, as discussions have been going on in a vicious circle since late 2019.

The meetings of the so-called Constitutional Committee, which was launched under the auspices of Russia, Turkey and Iran, continue, amid disagreements between the participants and the absence of real representatives of the people, despite the failure of seven previous sessions.

During the eighth round, the so-called Constitutional Committee discussed the principle of “the supremacy of the constitution and the hierarchy of international agreements and treaties” presented by the delegation of the so-called opposition in the committee, after two days of discussing the two principles of “unilateral coercive measures from a constitutional standpoint” presented by the delegation of the so-called civil society. And “Preserving and Strengthening State Institutions,” which was presented by the Damascus Government delegation.

In this context, Dr. Samira Moubayed, member of the committee of the “Civil Society” she cancelled her participation with the so-called of the Constitutional Committee in its 8 session.

Samira Moubayed added other motives for her decision, which are "the domination of the civil voice by the parties to the conflict and its recruitment to serve their proposals away from pushing for and achieving the interests of the Syrians, the successive failure of eight constitutional sessions, the failure to evaluate the previous track, and the failure to respond to the demands of evaluating the mechanisms, the goal and the work required of the committee."

absurd discussions for more than two years

Since 2019, delegations have been discussing "constitutional principles", none of which were approved, and the result of previous rounds in Geneva, under the supervision of the United Nations, was repeated failure.

Samira Moubayed, in this context, clarified that "after two and a half years, this committee has not made any progress. Both the regime and the opposition deal with the work of the Constitutional Committee from the standpoint of each party's practice to achieve its interests and what it considers the gains of the military conflict and an attempt to continue in power. If this is not achieved, it the parties concerned with obstruction and procrastination, therefore, cannot be relied upon that these parties will be able to build a modern Syrian constitution and a foundation for the state of citizenship.”

Samira Moubayed stressed that these meetings "result in absurd discussions that do not lead to any goal and cannot find a solution for the Syrians. It is the mentality of power-sharing according to the frameworks of the totalitarian system itself, not the mentality of change. The solution that these parties seek is a solution that guarantees their survival, not a solution for the Syrians."

Damascus and the coalition... two parties that cannot adopt constitutional proposals

During the previous rounds, the delegations of the Damascus Government and the so-called opposition used to put forward principles on the rule of law, justice, human rights and state sovereignty, but these two parties are accused of carrying out practices that contradict these principles that they are talking about.

Samira Moubayed, in this context, indicated that "these parties are discussing human rights principles and the necessity of including them in the constitution, while the areas under the control of both parties are considered one example of human rights violations, and this undermines the ability of the two parties to build a Syrian constitution that guarantees basic rights from lack of discrimination and not being subjected to persecution on cultural, religious, national or other grounds. Both parties committed grave violations and they cannot adopt these proposals.

A catastrophic scenario…the industrialization of similar ideologically, nationally and sectarian areas

In addition, the proposals of the delegations of the Damascus Government and the so-called opposition during the seventh round in particular by talking about "the identity of the state and its symbols" provoked condemning reactions and warnings that it calls for the consolidation of the Arabism of Syria at the expense of other components.

Samira Moubayed added, "What appears until today is the efforts of the two parties to make minor amendments to the current constitution, which leads to the inclusion of the opposition within the authority, in the areas it controls, and this scenario is catastrophic for the Syrians, as it will lead to the continuation of Syrians being subjected to a repressive and totalitarian rule with multiple frameworks, in addition to what this scenario requires in terms of the displacement of Syrian human groups based on attempts to create similar ideologically, nationally or sectarian areas, in contrast to the structure and nature of Syrian society, and the formation of areas of continuous inter-conflict that drains Syria’s resources and leads its children to death as fuel for these wars.

The "safe zone"... Drawing the borders of the division of Syria

Within the framework of these warnings by Samira Moubayed, and in conjunction with the convening of the so-called constitutional committee, Turkey began deporting Syrian refugees under the title of "voluntary return" and resettling them in the Syrian areas it occupies with the aim of establishing what it called the safe zone.

Dr. Samira Moubayed added, in this context, "It is more useful for neighboring countries that host Syrian refugees to secure for them the conditions of citizenship and sustainable stability in their areas of presence, rather than demanding areas called safe, with the aim of drawing the boundaries of the division and sharing of Syria at the expense of the Syrian people in a repetition of a scenario that was applied a century ago. It has passed, and we are still paying the price for its bitter harvest to this day, and we have to reject it with complete clarity."
