European Council calls on Turkey to provide information on Imrali

 The Ministerial Committee of the European Council also discussed the file of the Imrali case during its meetings on November 29 and January 2, and in its session on January 1, the Committee discussed discussions about Turkey, where the Committee asked it to provide information on the decision of “Ocalan 2” and the other detainees. 

 The Ministerial Committee called on the Turkish authorities to provide information on their progress in implementing the general measures by September 2022.

 In short, the committee's decisions are:

 As there is no mechanism in Turkish law to investigate aggravated prison sentences, this case blocks the way for the inhumane treatment of detainees, and this violation result should not give applicants any hope that the detainees will be released, but the national authorities should establish an investigation mechanism in accordance with the standards set by the court

 - The European Court of Human Rights (DMME) has established that there is no violation of Article 3 of the Convention on Conditions of Detention after the period of November 17, 2009 in the Ocalan Case (No:2), and the court is also busy applying the conditions of detention from  while being monitored by the European Committee for the Prevention of Torture and Inhuman Treatment or Punishment, no personal action is required under the applicants’ conditions of detention, and individual actions are not related to the implementation of public proceedings.

 - It turns out that personal measures in this regard are related to general measures

 As the European Court of Human Rights has made clear, if an investigation mechanism is implemented, the conditions for a meeting will be met in order to demand parole, but if the authorities come to the conclusion that this person will represent a danger to society, this does not mean that the conditional release will be achieved. 

 Officials did not provide sufficient information about the violations mentioned in the report, and were called upon to benefit from the court's standards in accordance with the legal framework, and encouraged them to benefit from good examples of reforms in other member states.

 At the same time, it is requested information about the detainees who were sentenced to life imprisonment.

 In order to develop the implementation of the general measures, officials must provide information by the end of September 2022.
